Eight years later and the infamous wardrobe malfunction is still something that is being talked about. The incident really has lived up to its name of being infamous because the Federal Trade Commission has filed an appeal to the Supreme Court asking them to review the decision to throw out the agency’s fine against CBS. The 2004 incident required for the FCC to hold $550,000 against CBS.

The FCC are asking that the court hold the case until they have ruled on another indecency case involving Fox. This will likely occur within the next few months. The FCC is arguing that the Second Circuit court misinterpreted their policy. However, keep in mind that the Third Circuit Court denied a re-hearing of the case in January.
