The truck driver who collided with a limo bus carrying Tracy Morgan, fellow comedian James “Jimmy Mack” McNair and others, has been indicted by a grand jury.

THR reports that Kevin Roper, a driver for Walmart, has been charged with first-degree aggravated manslaughter, second-degree vehicular homicide, and third degree aggravated assault stemming from the 2014 crash on the New Jersey Turnpike.

James McNair was killed in the crash, while Tracy Morgan was left seriously injured. Before the charges came down, Roper’s attorney argued that a previous settlement between Walmart and Morgan could hurt his client’s chances at receiving a fair trial. Roper is scheduled to be arraigned at a later date.

According to a NTSB investigation following the accident, Roper had been awake for 28 hours on the night of the crash.

The report also noted that the severity of the passengers injuries on the limo bus could be contributed in-part to their decision not to wear seat belts.
